These Terms of Service ("Terms") govern your use of the Proper Grove website at proper-grove.com (the "Site") and your registration to receive marketing communications. By using the Site or submitting the registration form, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or register.
01About these Terms
These Terms form a binding agreement between you and Proper Grove. They apply to your use of the Site and to the marketing relationship you create by registering. They are separate from any property-management services agreement you may enter into with Proper Grove, which would be governed by its own contract.
02Eligibility — you must be 18 or older
You must be at least 18 years old to use the Site and to register for marketing communications. By registering, you represent and warrant that you are 18 or older. The Site and our communications are not directed to, and we do not knowingly collect information from, anyone under 18.
03Registration & accuracy of information
When you register, you agree to provide true, accurate, and complete information — including your real name, email address, phone number, and postal address — and to keep it up to date. You agree to submit only contact information that belongs to you and that you are authorized to provide. Registrations are confirmed through a double opt-in process: we email you a verification link, and your registration is complete only after you click it.
04Marketing consent
By checking the consent box on the registration form, you agree that Proper Grove and its marketing partners may contact you at the email address and phone number you provided — including marketing emails, calls, and text messages sent using automated technology and/or prerecorded messages — about relevant products and services.
Consent is not a condition of any purchase. You are not required to agree to receive marketing communications in order to buy any product or service from Proper Grove. You may withdraw your consent at any time as described in Section 6.

05Messaging & SMS terms
- Message frequency varies. Message and data rates may apply according to your mobile carrier plan.
- Reply STOP to any text message to opt out of texts; reply HELP for assistance.
- Carriers are not liable for delayed or undelivered messages.
- Consent to receive texts is not required to purchase any goods or services.
06Opting out
You may withdraw your consent and stop receiving marketing communications at any time:
- Click "unsubscribe" in any marketing email;
- Reply STOP to any text message;
- Email privacy@proper-grove.com to be removed from all Proper Grove marketing and to have us instruct our partners to stop contacting you.
We process opt-outs promptly. As described in our Privacy Policy, we retain proof-of-consent records as required by applicable law even after you opt out.
07Acceptable use
You agree not to misuse the Site, including by: submitting false, fraudulent, or another person's information without authorization; attempting to disrupt, probe, or gain unauthorized access to the Site or its systems; scraping or harvesting data; or using the Site for any unlawful purpose. We may suspend or terminate access for any violation.
08Intellectual property
The Site and its content — including text, graphics, logos, the Proper Grove name and leaf mark, and design — are owned by Proper Grove or its licensors and are protected by intellectual-property laws. You may not copy, reproduce, or create derivative works from the Site without our prior written permission, except as permitted for ordinary personal viewing.
09Disclaimers
The Site and our communications are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Information we send is for general marketing and informational purposes and is not professional, legal, or financial advice. Offers from marketing partners are the responsibility of those partners.
10Limitation of liability
To the fullest extent permitted by law, Proper Grove and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Site or our communications. Our total liability for any claim relating to these Terms will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11Governing law & changes
These Terms are governed by the laws of the State in which Proper Grove is organized, without regard to conflict-of-law principles. We may update these Terms from time to time; when we do, we will revise the "Last updated" date above. Your continued use of the Site or participation in our marketing after changes take effect means you accept the revised Terms.
